Overtaking is only overtaking if you move into the lane the overtaken car was in, otherwise it's just "driving faster", at least in the way road rules work over here.
(We drive on the left as most of you know, so just switch it around)
Over here it would be illegal, and known as 'undertaking' (subtle pun) to overtake from a left lane to a righter lane, however moving past a car towards your right while in the left lane does not constitute 'overtaking' unless you physically cross their lane.
